Litigation & Arbitration

Representation before every Haitian jurisdiction and in international arbitration. An experienced team in civil, commercial and administrative proceedings.

Litigation demands strategy, procedural rigor and a precise knowledge of the courts. Cabinet Chevalier pleads before every Haitian jurisdiction — civil, commercial, administrative — and runs international arbitrations for Haitian and foreign clients. Our approach: prepare every file as if it were going to appeal, and negotiate as if it could settle today.

What we do

  • Civil, commercial and corporate litigation
  • Civil rights and fundamental liberties litigation
  • Consumer advocacy litigation
  • Administrative proceedings and tax disputes
  • International commercial arbitration (ICC, AAA, LCIA)
  • Alternative dispute resolution (mediation, conciliation)
  • Appeals and Supreme Court proceedings
01

Strategy first

Every dispute begins with an honest analysis: the strengths and weaknesses of the file, expected costs, probable timeline, the real prospects of enforcement. We present clients with a clear, costed battle plan before initiating any proceeding. That discipline avoids losing cases from the outset and unlocks favorable settlements.

02

Pleading before Haitian courts

Our partners plead regularly before first-instance courts, commercial courts, courts of appeal and the Supreme Court. We handle civil law (liability, contract enforcement, civil rights, consumer protection), commercial law (competition, distribution, corporate disputes between shareholders) and administrative law (claims against government, public procurement disputes).

03

International arbitration

For cross-border disputes, international arbitration offers decisive advantages: confidentiality, forum neutrality, enforcement facilitated by the New York Convention. We represent clients before the major arbitral institutions and advise upstream on drafting arbitration clauses.

Why work with us

Experienced trial lawyers

Three partners regularly pleading before every Haitian jurisdiction for over fifteen years.

Honest analysis upfront

We tell clients what their file is worth — not what they want to hear. That avoids expensive, unnecessary proceedings.

Real enforcement

Winning a case is not enough: we follow through with forced enforcement until the judgment actually delivers value.

Frequently asked questions

How long does commercial litigation take in Haiti?+

First-instance cases typically resolve in one to two years. With appeals, a full process can take three to five years. That is precisely why a clear initial strategy matters.

Settle or litigate?+

It depends on the file. A well-negotiated settlement is often worth more than a distant judicial victory. We systematically analyze both paths in parallel and advise based on the client's real interest.

How does international arbitration work?+

Arbitration follows the rules of the chosen institution (ICC, AAA, LCIA…) or the parties' agreement. Proceedings are generally faster than state courts, confidential, and the award can be enforced in most countries under the 1958 New York Convention.

What if the other party refuses to honor the judgment?+

We pursue forced enforcement: third-party attachments, execution attachments, judicial mortgages. For foreign judgments, we handle the exequatur proceedings in Haiti.
